MyCovenantHealth Patient Portal Terms of Use

Overview

MyCovenantHealth Patient Portal provides a view into your Electronic Medical Record (EMR) and gives you a secure way to communicate with your care team. However, the information available for you to view through MyCovenantHealth Patient Portal is not a comprehensive view of all the data in your EMR.

The MyCovenantHealth Patient Portal and its use are governed by these Terms of Use (Terms). If you do not agree to these Terms, you may not establish or maintain a MyCovenantHealth Patient Portal connection. By using or accessing the MyCovenantHealth Patient Portal you agree to be bound by these Terms.

Creating and Accessing Your MyCovenantHealth Patient Portal

You must be at least 18 years old to establish a connection to the MyCovenantHealth Patient Portal and to have a MyCovenantHealth Patient Portal Account.

Use of your account is your responsibility, so you agree to keep your name and password confidential. If you learn or suspect that your user name or password has been wrongfully used or disclosed, you should promptly notify us and immediately reset your password. To help ensure the security of your password or account, please sign out of your account at the end of each session.

Your Information

The information available for you to view through the MyCovenantHealth Patient Portal is not a comprehensive view of all the data in your healthcare provider's EMR. The information on the Patient Portal may be missing portions of your healthcare records, may contain inaccurate information, and/or may contain draft/incomplete documentation due to Covenant’s policy of making medical records immediately available to you at the time or near the time of the creation of the information. 

If you have any questions after reviewing the information on the MyCovenantHealth Patient Portal, particularly questions regarding laboratory, radiology, pathology, and/or microbiology results and any diagnoses or medical conditions, you agree to contact a healthcare provider to discuss your concerns, your questions, your current medical condition, and/or any future treatment needs.  

Use of the Portal

Your interactions with MyCovenantHealth Patient Portal (such as secure messaging, scheduling and completing questionnaires) are interactions with your healthcare provider. You agree not to post or transmit any information through MyCovenantHealth Patient Portal that infringes the rights of others or violates their privacy or publicity rights; in particular (without limitation) you must not post or transmit material which is of a bullying, harassing or discriminatory nature.

Maintaining Another Person's Connection

If you are legally authorized to view another person's health information, you may be given access to the MyCovenantHealth Patient Portal for that person, subject to these Terms. Various federal and state regulations prohibit sharing certain categories of sensitive information with anyone other than the patient. As such, we may restrict your access to the other person's sensitive information and not make it available to you through the MyCovenantHealth Patient Portal.

Proxy Use of the MyCovenantHealth Patient Portal

You may also authorize a proxy to view and interact with the MyCovenantHealth Patient Portal based on the specific privileges you've assigned. You may authorize any person who qualifies for a MyCovenantHealth Patient Portal connection to be a proxy. Access or privileges you give to someone can be modified or removed by you at any time, for any reason, by adjusting the proxy settings in the MyCovenantHealth Patient Portal. If you share information from the MyCovenantHealth Patient Portal with another individual, you acknowledge and accept responsibility for your decision to provide them access to your potentially sensitive healthcare information.

Telemedicine

Covenant Health-affiliated providers (“Providers”) with whom you have connections may offer medical services through electronic or digital means, including interactive audio and video visits, e-Visits (including, but not limited to, patient portal messaging), and other communication services, like telephone calls (collectively, “Telemedicine”).  If you initiate this type of visit or communication with a Provider, you represent you meet all applicable criteria for the service and that information you furnish to the Provider is true, accurate, and complete. Covenant Health and the Providers are not responsible for any false or misleading information you provide, or any other misrepresentations you make.

Consent To and Charges for Telemedicine

Risks and Benefits: Benefits of Telemedicine include enhanced access to care, patient convenience, and reduced risk of exposure to communicable disease. Medical information is protected to the same extent as in a face-to-face visit, although confidentiality and privacy at the patient’s location is not controlled by the Provider. There are risks and limitations to Telemedicine. Telemedicine and related care may not be as complete as face-to-face services as a result of a Provider’s potential lack of access to all diagnostic modalities/medical equipment necessary to obtain vital signs, labs, and other pertinent health information to treat the patient, lack of access to complete medical records, and problems with information transmission, including missed information or inaccurate information being transmitted, that could affect a Provider’s medical decision-making. Further, although the Providers use available encryption and privacy modes for Telemedicine, it is also possible security protocols could fail, causing a breach of privacy of medical information. The alternative is a face-to-face visit, which the patient may request at any time, but an equivalent in-person service may not be available at the same location or time as a Telemedicine visit. During a Telemedicine visit, a Provider may perform a physical exam through the use of technology or a facilitator in the room with the patient. Not all medical conditions can be treated as effectively through a Telemedicine visit, including emergency conditions. If a Provider determines a face-to-face evaluation is needed, the patient may be referred to an appropriate location for such evaluation. A Provider can withdraw from a Telemedicine visit for any reason, including when, in the Provider’s medical judgment, treatment is not safe, private, or effective. In such event, the Provider can instruct the patient to seek in-person care and the patient agrees to follow such instruction, including for emergency care.

Charges. Telemedicine is subject to charges consistent with the Provider Registration/Admissions Agreements, the terms and conditions of which are incorporated by reference. Not all insurers cover Telemedicine. Any amount not paid in full by insurance, for any reason, is the responsibility of the patient (i.e., the patient is liable for the uninsured portion of the Provider bill, which is due in full when services are rendered).

Consent. By electing to proceed with Telemedicine, you acknowledge you have been informed of the risks and benefits of Telemedicine; you understand and agree to these Terms, including that the patient is liable and individually obligated for payment of the Provider’s charges on the patient’s account for Telemedicine services; and you consent to medical treatment or consultation by means of Telemedicine.

Disclosure of Information

We may, in our sole and reasonable discretion, disclose any information necessary to satisfy applicable law, regulation, legal process or governmental request.

Privacy

You agree to the terms and conditions of the MyCovenantHealth Patient Portal Privacy Policy which is incorporated into and made part of these Terms. You also acknowledge receipt of and agree to the terms of our Notice of Privacy Practices, which are incorporated into and made part of these Terms.

Third Party Programs, Activities and Services

Covenant Health does not endorse any programs, activities, or services offered by third parties. We make no warranty of any kind as to the accuracy, completeness or appropriateness of any such programs, activities, or services.

External Links

In order to provide you with greater value, the MyCovenantHealth Patient Portal may provide you with links to various third party Web sites. Even if a third-party affiliation exists between Covenant Health and that destination site, Covenant Health and your healthcare provider(s) exercise no authority over linked sites, each of which maintains independent privacy and data collection policies and procedures. We assume no responsibility or liability for these independent methods or actions and are not responsible for the independent policies or procedures of destination sites. Similarly, Covenant Health and your healthcare providers do not take responsibility for the privacy initiatives or the content of such Web sites. These destination links are provided only for your convenience, and as such, you access them at your own risk.

No Medical Advice; No Warranties; Limitation of Liability; Release

The MyCovenantHealth Patient Portal is an information management tool only and is for your personal and non-commercial use. Except for patient portal communications with a treating provider, Covenant Health does not provide medical advice through use of the MyCovenantHealth Patient Portal, and use of the MyCovenantHealth Patient Portal is not a substitute for medical treatment by a health care professional.   You and your healthcare provider are responsible for all medical treatment decisions. You should consult your healthcare provider with any questions regarding the information provided by the MyCovenantHealth Patient Portal. YOU ACKNOWLEDGE AND AGREE THAT COVENANT HEALTH, ANY COVENANT HEALTH AFFILIATED HOSPITAL, YOUR HEALTH CARE PROVIDERS, AND ALL EMPLOYEES OR AFFILIATES OF THE SAME HAVE NOT REPRESENTED MYCOVENANTHEALTH PATIENT PORTAL AS HAVING THE ABILITY TO PROVIDE MEDICAL ADVICE OR RECOMMENDATIONS, DIAGNOSE DISEASE, PRESCRIBE TREATMENT, OR PERFORM ANY OTHER TASKS THAT CONSTITUTE THE PRACTICE OF MEDICINE OR OF OTHER PROFESSIONAL OR ACADEMIC DISCIPLINES. NEITHER YOUR HEALTHCARE PROVIDER COVENANT HEALTH, NOR ANY OF THEIR SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS OR EMPLOYEES, WILL BE LIABLE OR HAVE ANY RESPONSIBILITY OF ANY KIND FOR ANY LOSS OR DAMAGE THAT YOU INCUR IN THE EVENT OF ANY FAILURE OR INTERRUPTION OF THE MYCOVENANTHEALTH PATIENT PORTAL, OR RESULTING FROM THE ACT OR OMISSION OF ANY OTHER PARTY INVOLVED IN MAKING THE MYCOVENANTHEALTH PATIENT PORTAL OR THE CONTENT CONTAINED THEREIN AVAILABLE TO YOU, OR FROM ANY OTHER CAUSE RELATING TO YOUR ACCESS TO OR YOUR INABILITY TO ACCESS THE MYCOVENANTHEALTH PATIENT PORTAL, WHETHER OR NOT THE CIRCUMSTANCES GIVING RISE TO SUCH CAUSE MAY HAVE BEEN WITHIN THE CONTROL OF COVENANT HEALTH OR OF ANY VENDOR PROVIDING SOFTWARE OR SERVICES SUPPORT.

You are responsible for any acts or omissions relating to your use of the MyCovenantHealth Patient Portal and for any damages incurred as a result thereof. THE MYCOVENANTHEALTH PATIENT PORTAL IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT, AND OUR SUPPLIERS DO NOT (I) WARRANT THE RELIABILITY OR AVAILABILITY OF THE MYCOVENANTHEALTH PATIENT PORTAL, OR (II) GUARANTEE THAT ACCESS TO THE MYCOVENANTHEALTH PATIENT PORTAL WILL BE ERROR-FREE OR UNINTERRUPTED OR THAT DEFECTS WILL BE CORRECTED. WE AND OUR SUPPLIERS EACH DISCLAIM, TO THE EXTENT PERMITTED BY LAW, ALL WARRANTIES, EXPRESS AND IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ON BEHALF OF US AND OUR SUPPLIERS, ALL RESPONSIBILITY FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, AND PUNITIVE DAMAGES, AND LOST PROFITS, REVENUES OR DATA RELATED TO USE OF THE MYCOVENANTHEALTH PATIENT PORTAL.

Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD COVENANT HEALTH, ITS SUPPLIERS, AND YOUR HEALTHCARE PROVIDER HARMLESS FROM AND AGAINST ALL CLAIMS, DAMAGES, AND EXPENSES ARISING OUT OF OR RELATED TO YOUR USE OF THE MYCOVENANTHEALTH PATIENT PORTAL. FURTHER, YOU AGREE TO INDEMNIFY AND HOLD COVENANT HEALTH, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, CONTENT PROVIDERS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS, AND CONTRACTORS (THE “INDEMNIFIED PARTIES”) HARMLESS FROM AND AGAINST ALL LOSSES, EXPENSES, DAMAGES AND COSTS, INCLUDING REASONABLE ATTORNEY’S FEES, ARISING AS A RESULT OF (A) ANY BREACH OF THESE TERMS BY YOU, INCLUDING ANY USE OF THE MYCOVENANTHEALTH PATIENT PORTAL OTHER THAN AS EXPRESSLY AUTHORIZED IN THESE TERMS; AND (B) ANY ACTIVITY RELATED TO ANY ACCOUNT YOU CREATE, INCLUDING ANY NEGLIGENT OR WRONGFUL CONDUCT BY YOU OR ANY OTHER PERSON ACCESSING YOUR ACCOUNT. YOU AGREE THAT THE INDEMNIFIED PARTIES WILL HAVE NO LIABILITY IN CONNECTION WITH ANY SUCH BREACH OR UNAUTHORIZED USE, AND YOU AGREE TO INDEMNIFY ANY AND ALL RESULTING LOSS, DAMAGES, JUDGMENTS, AWARDS, COSTS, EXPENSES, AND ATTORNEY’S FEES OF THE INDEMNIFIED PARTIES IN CONNECTION THEREWITH.

Termination

Covenant Health may terminate the MyCovenantHealth Patient Portal services at any time. Your account access may be terminated, suspended or deleted, at any time and for any reason, without providing notice to you.

No Unlawful or Prohibited Use

You may not use the MyCovenantHealth Patient Portal for any purpose that is unlawful, immoral or is otherwise prohibited by these Terms. You may not use the MyCovenantHealth Patient Portal in any manner which could damage, disable, overburden, or impair the MyCovenantHealth Patient Portal or interfere with any other party's use and enjoyment of the MyCovenantHealth Patient Portal. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided to you through the MyCovenantHealth Patient Portal.

We may deliver notice to you by means of electronic mail, a general notice on our website, or by written communication delivered by first class U.S. mail to your address in our records. General

These terms are governed by the laws of the State of Tennessee. You consent to the exclusive jurisdiction and venue of courts in Knox County, Tennessee, U.S.A. in all disputes against Covenant Health and its affiliated providers arising out of or relating to the use of the MyCovenantHealth Patient Portal. Any cause of action or claim you may have with respect to the MyCovenantHealth Patient Portal must be commenced within one (1) year after the claim or cause of action arises. Covenant Health’s failure to enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right. We may assign our rights and duties to any party at any time without notice to you, and may provide services to you though our business partners and suppliers.

Our performance of these Terms is subject to existing laws and legal process, and nothing contained in these terms is in derogation of our obligation to comply with governmental, court and law enforcement requests or requirements relating to your use of the MyCovenantHealth Patient Portal or information provided to or gathered by us with respect to such use. If any part of these Terms is determined to be invalid or unenforceable, the invalid or unenforceable provision shall be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms shall continue in effect. If any of these provisions should be deemed invalid or unenforceable and cannot be so changed, the provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. Unless specified otherwise as you use the MyCovenantHealth Patient Portal, these Terms constitute Covenant Health’s and your healthcare provider’s entire agreement with you with respect to the MyCovenantHealth Patient Portal and these Terms supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between us with respect to the MyCovenantHealth Patient Portal.

Notification of Changes to This Terms of Use

Covenant Health may change these Terms at any time and without advance notice to you. We display an effective date on the terms above so that it will be easier for you to know when there has been a change. You are responsible for regularly reviewing these Terms. Your continued use of the MyCovenantHealth Patient Portal constitutes your acceptance of the revised terms. Small changes or changes that do not significantly affect individual privacy interests may be made at any time and without prior notice.
